Terms of Service
These terms govern your use of Rowan, a point-of-sale application provided by Recherché Merchant Solutions, Inc. ("RMS", "we", "us"). By installing or using Rowan you agree to these terms on behalf of your business.
1. The service
Rowan runs inside your CRM account and stores point-of-sale records (tickets, payments, inventory, time and tip records) to provide the service. We may improve, change or retire features over time.
2. Your account and your team
You are responsible for who you give access to, the roles and PINs you assign, and activity under your account. Keep PINs, terminal keys and passwords private.
3. Payments
Card payments are processed by your payment processor and terminal provider under your agreement with them, not by RMS. Rowan sends sale amounts to your terminal and records the result. Pricing programs such as dual pricing, cash discount or surcharging must be configured and disclosed in line with card brand rules and the laws where you operate; you are responsible for that compliance.
4. Messages and automations
Automations send messages only when you turn them on. You are responsible for having consent to contact your clients and for complying with messaging laws and carrier rules, including registration requirements for text messaging.
5. Taxes, tips and payroll
Rowan provides reports to help with sales tax, tips and payroll. You and your accountant remain responsible for filings, withholding and records. Rowan is not tax or legal advice.
6. Fees
Fees for Rowan are set out in your plan or agreement. If fees change, we'll give notice before the change takes effect.
7. Your data
You own your business data. We use it only to provide and support Rowan, as described in our Privacy Policy. You can request an export of your Rowan records.
8. Acceptable use
Don't use Rowan to break the law, process prohibited transactions, send unsolicited messages, or interfere with the service or other users.
9. Availability and changes
We work to keep Rowan available but don't guarantee uninterrupted service. Card terminals, your CRM and third-party services can affect availability.
10. Disclaimers and liability
Rowan is provided "as is." To the extent allowed by law, RMS is not liable for indirect, incidental or consequential damages, or for lost profits, and our total liability is limited to the fees you paid for Rowan in the twelve months before the claim.
11. Ending use
You can uninstall Rowan at any time. We may suspend access for non-payment or misuse. After you leave, we'll keep your records for a reasonable period so you can request an export, then delete them.
12. Governing law
These terms are governed by the laws of the State of Oklahoma.
